Right of Withdrawal
Right of withdrawal from a distance sales contract:
- The Consumer has the right to withdraw from a distance sales contract within 30 days without giving any reason.
- In the event of withdrawal from a distance contract, the contract is considered not concluded.
- The deadline for withdrawal from the sales contract expires 30 days after the day on which the Consumer acquires physical possession of the goods, or receives the last part of an order if it is delivered in parts.
- To meet the deadline, it is sufficient for the Consumer to notify the Seller of their decision to withdraw from the contract by an oral, written, or any other form chosen by the Consumer before the withdrawal period expires.
- The Consumer may use the withdrawal form template below, but it is not mandatory.
- If the Consumer informs the Seller about the withdrawal via email or other electronic communication, the Seller shall promptly send a confirmation of receipt of the withdrawal statement on a durable medium (e.g., email).
- No later than within 30 days from the day the Consumer submits the withdrawal statement, or together with that statement, the Consumer must return the purchased goods to the Shop in unchanged condition, unless the change was necessary within the scope of ordinary management.
- The Consumer bears no costs for exercising the right of withdrawal, except for the direct costs of returning the goods to the Shop.
- The Seller shall immediately refund payments using the same payment methods used by the Consumer in the original transaction unless the Consumer expressly agrees otherwise; in all cases, the Consumer shall not incur any fees related to the refund.
- Within 30 days from receiving the Consumer’s withdrawal statement, the Seller is obliged to refund all payments made by the Consumer, including delivery costs. This does not include the costs of returning the goods to the Shop.
- If the Seller has not agreed to collect the goods from the Consumer, they may withhold the refund until the goods are received back or until the Consumer provides proof of shipment, whichever occurs first.
- The right of withdrawal does not apply in cases where the Seller provides:
- non-prefabricated goods made according to the Consumer’s specifications or tailored to their individual needs;
- goods delivered in sealed packaging which cannot be returned once opened for health or hygiene reasons;
- goods that, by their nature, are inseparably mixed with other goods after delivery.
